TERMS OF SERVICE

GUIDELINES IN PLACE TO ENSURE PROPER EXPECTATIONS & UNDERSTANDING

By ordering services from Pixel Crew Media, the client agrees to the following Service Agreement for video and photo needs. We have these guidelines in place to ensure a smooth and efficient service is completed by me as Pixel Crew Media and received by you as the client.

APPOINTMENT REQUESTS:

  • To ensure the best results of the appointment, please be sure the property is ready prior to the scheduled appointment.

  • By confirming your appointment, client agrees to the readiness expectations and policy: you agree that the home will be ready to photograph and film on the scheduled date and time you have selected. This includes working with the builder and seller to ensure the home is photo and/or video ready and nothing has to be moved.

  • By confirming your appointment, client agrees that their photographer/videographer/drone operator is not required or responsible to direct client, seller, or anyone else as to what should be moved or how the interior or exterior of the home should be staged.

  • When the photographer arrives and the home that is not photo and/or video ready on the scheduled date and time will result in a rescheduling/cancellation fee of 100% of the invoice.

  • For liability purposes, Pixel Crew Media does not handle any of the prep for the readiness of the property, including but not limited to, cleaning or moving of furniture.

 

TIME, CANCELLATIONS, AND WEATHER POLICY: 

  • By confirming your appointment, you agree to Pixel Crew Media’s cancellation/reschedule policy: cancellation/reschedule of appointment is allowed up to the day before the appointment.

  • Any cancellation and/or rescheduling of appointment the same day will result in a rescheduling/cancellation fee of 50% of the total invoice. 

  • Any onsite cancellation and/or rescheduling of appointment will result in a rescheduling/cancellation fee of 100% of the total invoice.

  • We do not charge for a rescheduling fee due to weather related circumstances. However, we do not reschedule or cancel appointments due to clouds or potential rain. We replace all skies on our exterior photos with blue sky replacements NOTE: We cannot provide aerial/drone services while it is raining/there is moisture in the air or during hazardous wind conditions.

  • Turnaround time for video is typically 2 business days or less.

  • Turnaround time for photos is next business day delivery.

  • Next-day video rush delivery is available at a fee of $100. However, Pixel Crew Media may not always be able to provide this service.

 

TRAVEL & ADDITIONAL SQUARE FOOTAGE COST:

  • Pixel Crew Media covers a 30 mile radius within the chosen photographer’s home location. In the case Pixel Crew Media is needed to travel 30 miles outside of their central office location, there will be an additional travel fee for any miles traveled (this includes travel to and from the location). This fee covers Pixel Crew Media’s time and operational cost. See below the travel fee breakdown:

    • Within a 29 mile radius of photographer

    • 30 - 50 miles radius of photographer = additional $50 travel fee

  • Additional costs for square footage can be found on the REAL ESTATE tab underneath RATES on the Pixel Crew Media website. Please see the breakdown for each package and square footage range. This fee covers Justin L Fricke Media’s time and operational cost on homes with additional square footage.

 

VIDEO POST-EDITING:

  • Pixel Crew Media’s video walk-throughs typically follow a format of drone/exterior footage followed by property walk-through, with royalty free music. If another format is needed, the client must provide specific requirements or details in the “comments” section when booking an appointment with Justin L Fricke Media.

  • Any additional edits to a video or photo order after Justin L Fricke Media has finalized it requires additional work for Pixel Crew Media (edits, re-export, upload to MLS, ZILLOW, YouTube, social media outlets, and more) and will be subject to a re-editing fee of $50.

 

LIMITED LICENSING RELEASE:

  • In order to provide my clients with the best service, Pixel Crew Media does not sell photographs or video; Pixel Crew Media licenses their use for the sell and promotion of the listing.

  • The fee quoted is dependent on (1) payment of the invoice in full within 30 days, and (2) using the video/photographs only as indicated.

  • Only the Client has permission to use the delivered photos and video on any electronic or printed forms of advertisement for the promotion of the listing.

  • Builders, stagers, designers, or “third parties” who wish to use photographs, or video owned by Pixel Crew Media must contact Pixel Crew Media directly for licensing and fees.

  • For image integrity and quality control, Pixel Crew Media asks that photographs and video not be heavily altered once delivered, however; re-sizing is okay.

  • Photographs and video in use by another real estate agent due to a loss or withdrawn of an expired listing cannot be assumed by a new agent and must contact Pixel Crew Media.

AIRBNB/STR LIMITED LICENSING RELEASE:

  •  In order to provide my clients with the best service, Pixel Crew Media does not sell photographs or video; Pixel Crew Media licenses their use for the sell and promotion of the listing.

  • The fee quoted is dependent on (1) payment of the invoice in full before media is available for download, and (2) using the video/photographs only as indicated.

  • Only the Client has permission to use the delivered photos, video, and on any electronic or printed forms of advertisement for the promotion of the listing.

  • Additional property manager, builders, stagers, designers, or “third parties” who wish to use photographs, video, or other media owned by Pixel Crew Media must contact Pixel Crew Media directly for licensing and fees.

  • For image integrity and quality control, Pixel Crew Media asks that photographs and video not be heavily altered once delivered, however; re-sizing is okay.

  • Photographs and video in use by another real estate agent due to a loss or withdrawn of an expired listing cannot be assumed by a new agent and must contact Pixel Crew Media.

PAYMENT & LATE FEES:

  • Full payment is due before content is made available for download. However, client can still view the content before making payment.

  • If payment is never made and/or content is never downloaded, amount that’s due will be added to the next invoice.

  • Booking a service with Pixel Crew Media means you agree and understand the invoice and services that you have scheduled. Orders may not be reduced or changed once services/work have been performed.

 

PHOTO & VIDEO USAGE:

  • Video and photos produced by Pixel Crew Media may be uploaded to any social media or MLS listing services by the client, solely for the promotion of the listing during the pendency of this agreement.

  • However, regardless of any terms and conditions of the MLS, at no time does this agreement provide the right to transfer copyright or any other exclusive rights as provided by the Copyright Act 17 U.S.C § 106.

  • Clients may not give or sell photo or video works to third parties such as: vendors, builders, clients, other realtors, investors, etc.

 

WORK PRODUCT OWNERSHIP:

  • Any copyrightable works, ideas, discoveries, inventions, patents, products, or other information (collectively, the “Work Product”) developed in whole or in part by Pixel Crew Media shall be the exclusive property of Justin L Fricke Media.

  • Pixel Crew Media reserves the right to use video and photos for advertising, display, publication, or other purposes.

  • All photos, samples, videos, and proofs remain the exclusive property of Pixel Crew Media unless waived by amendment to this agreement. Unauthorized use of photographs/video is a copyright violation and will result in the termination of this contract.

  • To meet our quality standards, photos and videos produced by Pixel Crew Media may not be altered or edited in any way. This includes: virtual staging by another company, adding filters, converting to a twilight image, editing the photos or video.

  • All works including, but not limited to, edited photographs, edited videos, unedited (RAW) photographs, and unedited (RAW) videos are considered to be copyrighted works of and owned by Pixel Crew Media.

  • Unless otherwise specified, Pixel Crew Media does not give unedited (RAW) photographs or videos to clients. Unedited photographs and/or videos may be licensed by the client for an additional fee.

 

PROPERTY OWNER APPROVAL:

  • Justin L Fricke Media makes every effort to maintain the privacy of the property owner's neighbors. All footage is focused on the property being filmed and Pixel Crew Media will do best to respect the privacy of anyone not directly involved. If necessary, the client may be required to ask for permission from neighbors before Pixel Crew Media begins filming.

 

SEVERABILITY:

  • If one or more of the provisions contained in the Agreement is found to be invalid, illegal or unenforceable in any respect, the validity, legality, and enforceability of the remaining provisions shall not be affected. Such provisions shall be revised only to the extent necessary to make them enforceable.
